If someone hits you in cross traffic at an intersection, and hits the side of your car you'd be less at fault than if he hit the front of your car -- in which case it'd be that you hit him. There are a lot of variables - do not ever admit fault. He was an inexperienced driver - and possible riding a vehicle that had not been assembled properly! Did he drive in front of your car? How did it happen? Did you hit him with the front of your car, or maybe a glancing hit to the side? If you hit him smack with the front of your car, you'll be more at fault. Also, a moped, by definition, is 50cc or less, is incapable of going over 35MPH, and has pedals. If what hit you has a 150cc engine it was a scooter or a motorcycle. This is an important distinction as mopeds in some states do jnot require the driver to be licensed. The word moped is a portmanteau of motor and pedal. Good luck. If I were the judge I will make sure that you lose. One more thing, it has nothing to do with "the sun glaring". The sun rises and sets everyday. Now you are blaming the sun too??? Grow up!
