Trouble is this…are you 16 or older and do you have a drivers license?
In most states if you are a minor without a drivers license then there is actually very little they can do unless some specific ordinance or statute exist that pertains. As a minor without a drivers license, depending on your state they have little to charge you through,,,they can’t take your license and they really can’t arrest you in most cases or apply points on something you don’t have through the courts…. they can turn you over to "juvey"
Once you are a licensed driver, car whatever… you are fair game because almost every state allows for officer discretion – meaning it’s up to him what violation to apply or not apply.
So what’s my point? It all depends on the officer who stops you and he might not care…I doubt it because #1 he stopped you or #2 he asked you a question for a reason. Either he knows something about the law or you did something to catch his attention. If you play lawyer you risk having your scooter towed and impounded or getting a ticket – either way you will pay so the point is if you like to gamble go ahead but just remember they apply the law for a living at their own discretion and to them driving is a privilege – regardless of what it is because in their minds the streets belong to them….
I own a Honda z50 and the cylinder wall on the outside states it’s a 49cc, but in fact it’s an 88cc.
Would a cop know the difference… He may wonder why you can drive so fast if it’s only a 50cc.
You do have a point but if you are caught speeding how are you going to explain it. But yes a agility 50 and 125 kymco look the same but 125 is much faster. I do not remember if it says the cc size on the sides or not.
